Softplay Terms and Conditions

Soft play Terms and Conditions Fortywinks Bristol

1. It is the Hirer’s responsibility to check the site measurements for the required package, and also to ensure that there is adequate space surrounding the play equipment. If sufficient space is not available at the venue site for the package ordered, we reserve the right to remove certain items, at our discretion, for health and safety reasons. However, you will still be charged for them.

2. Please allow 45-60 minutes before the event for us to deliver and set up the equipment, and also 30-45 minutes after the event for us to take down and remove the equipment.

3. Avoid mixing older children on the Soft Play, Play Equipment or Bouncy Castle(s) at the same time as younger ones.

 4. No food, drink or chewing gum to be allowed on or near the Soft Play, Play Equipment, this will avoid choking and mess. If the equipment is collected in a dirty condition then the person hiring it will incur a cleaning charge.

5. No glass drinking glasses or bottles to be used on or near the Soft Play, Play Equipment.

6. STRICTLY no alcohol or drug use on or near the Soft Play, Play Equipment – We will not be held liable for any damage, accidents or injury that occurs due to the consumption and effects of alcohol and/or drug use.

7. Please ensure that the Soft Play, Play Equipment is kept in a clean, dry condition. Any spillages must be cleaned and dried as soon as they occur – if we have to have the equipment professionally cleaned before the next hire, then you will incur a £30 cleaning charge.

8. Shoes MUST be removed before using the Soft Play, Play Equipment. Parents/guardians who enter the Soft Play area or walk over the padded floor tiles whilst supervising must remove their shoes, particularly heels. Any damage may result in the Hirer having to pay an additional fee for replacement or repair.

9. For hygiene reasons, socks should be worn at all times whilst using the Soft Play, Play Equipment.

10. The Hirer must ensure that all sharp objects, including but not limited to, badges, spectacles, earrings, jewellery etc. are removed prior to accessing the Soft Play, Play Equipment to ensure it remains undamaged from but not limited to, scratches, tears, dirt (of any kind), detached from its connecting item (if applicable) and in the same working condition as delivered. If damage does occur the Hirer will incur a repair or replacement charge to be paid immediately, unless otherwise agreed.

11. No face paints, party poppers, confetti, coloured streamers or silly string to be used either on or near the Soft Play, Play Equipment – any staining to our equipment will occur a cleaning fee of £30 for which the Hirer will be liable. If we are unable to remove the stain the hirer will be responsible for replacement/repair of the equipment damaged immediately, unless otherwise agreed .

12. Strictly NO acrobatics or gymnastics to be performed on the Soft Play, Play Equipment.

13. Please ensure that equipment hired is not scattered around the venue. Equipment must be collected and placed back to the set up area so we do not spend time looking for items when we arrive to collect. This will also save you time if you have a set time to be out of a venue.

14. Please do not release our equipment to anyone other than our delivery drivers. If the driver who delivers to you is not the driver who will collect from you they will inform you and give you a description of the person/people coming to collect to avoid confusion and theft of our equipment.

*****IMPORTANT PLEASE READ******

We require a £20 Ball pit Ball deposit once we have set up .

****Balls from the ball pit must be collected before our arrival (back into the ball pit ) to collect our equipment. If balls are not collected and put back the way the equipment was set up, your £20 deposit will not be returned as we have to pay extra time for staff to extend their hours working. This may affect us at our next set up for another party so please don’t make us late for our next party set up.********

 Health & Safety

1. The Hirer must ensure the equipment is supervised at ALL times by a responsible person over the age of 18, preferably the Hirer. We do not supervise the party/event. We and our staff accepts no liability for any damage, accidents or injuries that may occur whilst the equipment is on hire should there not be a responsible adult supervising at the time of the incident.

2. We will set up the equipment taking into account full safety of the children, and therefore large equipment, such as the ball pool must not be moved. We will not accept any liability for accidents, injury or damage during the period of hire if this has occurred. Photographs are taken to evidence this

 upon setup.

3. The Soft Play and Play Equipment is strictly for use by children under the age of 5 years. Under no circumstances should ADULTS play on the Soft Play or Play Equipment as this will, in time, result in damage to the Equipment or injury to the individual(s) / children.

5. Adults must not lean or sit on any Soft Play, Ball Pool walls, Play Equipment

6. Do not allow children with medical conditions, which may put them at risk of injury (i.e. brittle bone disease or temporary injuries), to use the Soft Play, Play Equipment.

WE WILL NOT LEAVE SOFT-PLAY EQUIPMENT IF YOU HAVE A FACE-PAINTER BOOKED .

All our pastel and white soft play is indoor Hire only from September to April ( May - August subject to weather condition’s , any rain Likely or damp ground we will NOT set up our soft play) Please do have a plan b incase of weather .

You will still be charged full price if we are not able to set up due to weather condition’s on the day and you do not have a plan B.

we do however have grey and white Soft Play set which we are happy to use outside as long as it is in a tent/marquee .We can add colour to

This package.

We expect the equipment to be left as you have received it .

Please also advise if equipment is not going to be set up on the ground floor , as this can add additional time to our set ups and our days schedule ,additional charges may apply .

CANCELLATIONS 

Your £25 deposit is non refundable .

If you need to cancel your booking you will not receive your deposit back , but we will allow you to transfer your deposit to rebook within 3 months of your original booking.

Any cancellations made within a week of your party you will forfeit your deposit and it will not be refundable and you will not be able to move to a new booking, we would require a new deposit.

Cancellations made within 48 hours of your booking full payment will be still be due.

Our white and pastel Castles are only available inside , we do not hire these outside.

HIRE AGREEMENT & SAFETY INSTRUCTIONS 

Including Terms and Conditions of Hire 

It is the responsibility of the person who is hiring this Equipment to ensure that all possible steps are taken to avoid injury or damage to the Inflatable. 

Please ensure that the following Safety Instructions are followed: 

•Inflatable Equipment will be fully secured to the ground at all times during use as per the manufacturers’ recommendations.

•Ensure that the area around the unit is completely clear at all time.

•Do not allow anyone on the Equipment during inflation or deflation.

•A responsible Adult (17+) must supervise the Inflatable at all times when in use.

•Do not allow Children & Adults on the Inflatable at the same time unless for the sole purpose of assisting a child.

•Please ensure that participants are not attempting somersaults and are clothed appropriately with nothing in their pockets.

•Climbing, hanging or sitting on walls is DANGEROUS and must not be allowed.

•Avoid large and small Children from using it at the same time.

•No food, drinks or chewing gum to be allowed on the Inflatable.

•All shoes, glasses, jewellery, badges MUST be removed before using the Inflatable.

No smoking or barbeques near or within an unsafe 

of the Inflatable.

•Always ensure that the Inflatable is not overcrowded, and limit numbers according to the age and size of Children using it.

•Always ensure Children are not pushing, colliding, fighting or behaving in a manner likely to injure or cause distress to others.

•No pets, toys or sharp instruments are allowed on the Inflatable.

•Do not allow anyone to bounce on the front safety step. 

•Ensure that no-one with a history of back or neck problems or any medical condition which could reasonably be aggravated by using the equipment is allowed on the Inflatable.

•Do not allow children around the back of the Inflatable unsupervised

•The Inflatable should not be used if it becomes wet on the jumping area or in the event of rain, the unit should not be used. 

•In the event that the blower stops working, please ensure all users get off the inflatable immediately.

•No person or persons under the influence of alcohol and/or prescribed and/or non prescribed drugs and/or any other intoxicating substance will use or supervise the Equipment.

DISCLAIMER - Please note that all persons using this Inflatable do so at their own risk. 

The person/s or organisation hiring this Inflatable equipment will not be responsible/liable for any damage or injury occurring from or as a result of misuse or reckless use. 

These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the hirer to ensure they are fully adhered to at all times. 

We cannot accept any responsibility for any injury caused to anyone using this equipment.

I have read the above agreement and fully understand and accept the conditions as above. 

I am aware that whilst in my care I am fully responsible for the Equipment and will pay for any loss or damage that may occur. 

Once you have paid your non refundable booking deposit of £50 this will secure your date .

The remaining balance will be due 5 days before if paying by bank transfer or on the day cash.

We require a £50 on the day damages/security deposit on our 12x12 castles and £100 on our larger castle, this will be returned upon collection providing no damage has been done. (We will do a walk around before we leave the castle with you to make sure all is well ) 

ALL OUTDOOR BOOKINGS WE  REQUIRE A £100 DAMAGES/SECURITY DEPOSIT.

WET WEATHER:

We are unable to control the great British weather , so we would recommend planning a plan B if the weather for the day of your party is looking like it will rain or there are high winds (any wind of gusts over 21mph ) we will NOT erect our castles due to health and safety being our upmost priority .

Wet castles can create serious accidents or injury’s.

We can move the castle inside if you have space to do so.

Or we will rebook you castle for another date .

We do not want to cancel parties and understand how devastating it can be , but safety is our main priority . 

Delivery - we will need a clear level access to bring bouncy castles into ( please advise if there are ANY steps)

A flattish section of grass to fit castle will be needed 

We can NOT take castles through the house.

It will only be pegged onto a GRASS surface.

We NEVER fix to artificial grass or concrete 

Inside it will be sandbagged .

Please also advise if equipment is not going to be set up on the ground floor , as this can add additional time to our set ups and our days schedule ,additional charges may apply .

CANCELLATIONS 

Your £50 booking deposit is non refundable .

General Terms and Conditions

General terms and conditions 

Forty winks Bristol Terms and conditions 

USER AGREEMENT TERMS AND CONDITIONS 

The Client, by placing an order via website, email, Facebook or phone, agrees that they accept the conditions of the rental agreement as set out below. 

Forty winks Bristol will email terms and conditions agreement, which will be signed on day of set up. 

The Client will then be supplied an email as confirmation of their booking, once we have received your £25 deposit. 

Please read terms and conditions, and any issues please contact us as soon as possible (within 24hours) if we do not hear anything within 24 hours then we assume you are happy with our terms and conditions and they will then come into effect. 

DEPOSITS AND BOOKING   

1, A £50 non-refundable deposit (this will be deducted from your final balance) will be required in order to reserve your party date payable by Bank transfer, or cash. If not received within 48 hours of your booking, your date and theme will be released. 

2,On the day there will be a security/damages deposit due of £50 or £100 (dependant on what you are hiring, we will advise) 

Not applicable if we are manning the equipment.

Your damages deposit paid will be returned in part/full dependent on a check of all equipment at collection. 

3,The full balance will be due 48 hours prior to party date by bank transfer if final payment is not received by this time will result in the cancellation of your party with no exception unless agreed cash on the day of set up (This needs to be paid prior to us leaving once we have set up ) 

4. Any changes to the booking must be received in writing/email and confirmed by Forty winks Bristolprior to event. 

5, All bookings are for a one overnight hire period for tents and teepees, all other hired equipment we will advise how long hire is for. 

 It also can be viewed on our webpage www.fortywinksbristol.com 

6. All prices are subject to change, however prices quoted at the time of booking will always be honored. 

CANCELLATION : Cancellations can be made 14 days prior to the scheduled party date but the £50 deposit is non-refundable, this may be applied towards the cost of another party if held within 90 days of the original party date. If you choose to cancel our services for any reason, your deposit will be forfeited. 

If beds are cancelled within 14 days of your party there will be a 1/2 price charge still for each bed. Within 7 days of party the full price of each bed cancelled will be still payable.

Forty winks Bristol reserves the right to cancel your party booking at any time, for any reason. We will always try to give as much notice as possible. Upon any such cancellation we will refund the Client any monies paid in respect of the party booking, within 7 days, should any refund be due Forty winks will not be liable to pay any compensation to the Client or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation. Forty winks Bristol reserves the right to terminate the booking without notice if there is a breach of these conditions.

DELIVERY AND SET UP:  

1, Assembly, styling, collection, set up and general laundering are included in the hire cost unless stated otherwise. 

2,Any delivery charges will be advised upon booking.

3, Delivery times can be between 8AM and 8PM on the date of the party. A 2 hour window for arrival will be given the day before event , with a half hour message when we are on our way. Please advise at time of booking if there is restrictions on set up/delivery times and collections , as we plan our route and you will be fitted in between above times.

The client is responsible for being present to accept delivery of the equipment and to sign terms and conditions. 

4 ,It is the client responsibility to check the site measurements for the required equipment, and to make sure there is adequate space surrounding our equipment. If sufficient space is not available at the event for the package ordered, we reserve the right to remove items at our discretion. 

(Upon doing a risk assessment for health and safety reasons )however you will be still charged for the items. If you are unsure please contact us with pictures and we will endeavor to help. (Teepees you will need 80cms wide and 150cms long each one).

5,The time required for complete set up is approximately 1 hour but may take more or less depending on the number of teepees and add-ons ordered, or equipment hired.

6,We ask that no children or guests are in the party area during set up in order to avoid a time delay .

7,All floor areas must be clean from dirt, dust & furniture before setup begins. Forty winks Bristol has the rights to refuse set up if the room is not clean or in a sanitary state, the party will not be refunded but the deposit will be returned 

8, All our equipment will be delivered in clean condition, should there be significant dirt/staining upon collection the client will be made liable for professional cleaning costs. 

9, please advise if you have pets present (ie:cats/dogs) if we collect equipment and it has any pet hair/stains on there will be a charge of £25 (for extra cleaning or dry cleaning ) plus any replacement of equipment if we are unable to get stains out .

COLLECTION:  

1,We will arrive the day after the party (if applicable and overnight hire) at a previously agreed time, to breakdown and collect items. Please DO NOT pack away items or equipment, we will do this on return, 

Please wash out and bottles/Glasses ready for collection . 

Please remove personal belongings and rubbish .

2,A walk-through will be performed with the client prior to breakdown to confirm there are no damages or issues. 

DAMAGES:  

1,General cleaning of all items are included in the hire price. 

2,The client will be responsible for the cost of replacing any Forty winks Bristol’s equipment damaged due to mistreatment while at the clients premises. This includes breakages of any of fortywinks equipment,  teepees frames/lights/breakfast trays, tears/holes in the teepee fabric/pillows/linens/soft toys/mattresses, or extra cleaning needed due to stains. 

3,If any item is damaged or stained, charges will be deducted from the damages deposit in order to replace the item. If the cost of damages  exceeds the amount of the damage deposit, an invoice will be sent to the client and must be paid by the client within 7 days . 

4,We politely request that there is no smoking around our equipment. This means in the room of setup or nearby (where smells may travel and linger). As our products are designed for the use of children we have to uphold the highest standards. Any equipment found to have been around smoke will incur additional costs of £25 to cover deep cleaning. 

5,It is the responsibility of the client to take duty of care and always supervise children with the hire equipment. Diligence must be taken with younger children on the clients premises as Forty winks Bristol hire equipment is not recommended for children under the age of 4. 

6,Assembly/Disassembly is the responsibility of the Forty winks Bristol team. Please allow our staff to set up and pack up all items for your safety and to reduce the risk of damage. 

DISCLAIMER : 

Forty winks is not liable for any accidents that occur during said rental period. The client accepts all liability when renting from Forty winks Bristol. 

The client is responsible for the security of the equipment at all times during the rental period. Any lost, broken, damaged or destroyed equipment will be charged to the client at full replacement value. 

We strictly provide entertainment. Please be aware that children need to be supervised. Forty winks Bristol will not be liable for any claim for personal injury, death, loss or damage to the property however caused. 

Any person using this equipment does so at their own risk, the person hiring the equipment will be liable for any damage or injuries which have occurred due to misuse or reckless use, 

The person hiring will take full responsibility for using our equipment. 

 Forty winks Bristol has the final decision in all matters relating to these Terms & Conditions 

PLEASE ADVISE IF HIRING FOOD/MAKE UP ITEMS IF THERE ARE ANY ALLERGIES OR DIETARY REQUIREMENTS AND LET US KNOW .

This also applies to any of our Pamper Packages , please advise if any allergies , it is the clients responsibility to check any ingredients in our products being used.

By signing this contract, you agree to the above booking and the terms and conditions stated above. 

I HAVE READ THE ABOVE AGREEMENT AND FULLY UNDERSTAND AND ACCEPT THE CONDITIONS ABOVE, I AM AWARE WHILST IN MY CARE I TAKE FULL RESPONSABILITY OF ALL EQUIPMENT SUPPLIED TO ME FROM FORTY WINKS BRISTOL, I WILL ALSO PAY FOR ANY LOSS OR DAMAGES TO ANY OF THE EQUIPMENT THAT MAY OCCUR, THIS INCLUDES ANY ITEMS BEING RETURNED IN UNACCEPTABLE CONDITION
